The Arbitration Council Foundation (ACF) is expanding its activities and seeks talented and experienced candidates with outstanding qualifications for three Legal Officer position based in Phnom Penh.

Key Duties and Responsibilities:

Provision of legal services to Arbitrators in labour dispute cases

  • Providing direct legal services to Arbitrators in labour dispute cases, including conducting legal research and analysis, drafting legal memoranda and performing assessments and recommendations regarding substantive and procedural issues;
  • Attending initial meetings with Arbitrators to discuss cases;
  • Working with LSD to prepare arbitration notes on the cases;
  • Attending arbitration hearings;
  • Conducting post-hearing conferences with Arbitrators;
  • Assisting Arbitrators in drafting Arbitral Awards;
  • Liaising with Arbitrators to finalize the Arbitral Awards;
  • Providing feedback to Arbitrators in labour dispute cases and on areas of potential improvement;
  • Coordinating with officials of the Secretariat of the Arbitration Council (SAC) in their provision of clerical and administrative support to the AC; and
  • Updating LSD and the Executive Director of the ACF on the progress of the labour dispute cases, as appropriate.

Stakeholders Training

  • Conducting training on labour dispute prevention and resolution, and development of arbitration skills;
  • Identifying training and continuing arbitration education needs among Arbitrators, officials of the SAC, LSD and stakeholders with regards to the labour dispute resolution process, case preparation and/or technical skills, and other subject areas, as appropriate; and
  • Developing and implementing (in cooperation with other ACF staff, including ACF Training & Communication Department, and appropriate external consultants) training, meetings and programme s which respond to these needs.

Preparing publications and other materials, systems and tools, as needed in support of the Arbitration Council

  • Assist in the preparation of publication and other materials, system and tools in support of the AC;
  • Providing technical assistance in preparation of AC digests, award compilation and other publication materials;
  • Reviewing and updating relevant arbitration research tools; and
  • Identifying and developing new materials, system and tools in cooperation with other ACF staff, Arbitrators and external consultants.

Organisational Participation

  • Participate in the planning process and implementation of project activities;
  • Liaise with stakeholders and entities in the public, private, and international organisation and non-governmental organisation sectors to ensure smooth implementation of various projects;
  • Assist to prepare quarterly and other reports under the direction of the Director of LSD and Executive Director;
  • Conduct follow-ups on arbitral award implementation;
  • Participate in meetings/activities as requested by the ACF and share views and experiences;
  • Provide assistance to other staff and colleagues at the ACF when and where there is appropriate request (with approval of supervisor); and
  • Perform other tasks as assigned or requested by supervisor, as necessary.

Requisite competencies and qualifications:

  • Bachelor’s degree or higher degree in law, industrial relation, or related fields;
  • At least two years’ experience in a legal position, working in the fields of labour law, alternative dispute resolution (including mediation, conciliation and arbitration), industrial relations, and/or legal instruction;
  • Excellent legal research, analysis, training and presentation skills;
  • Highly motivated, proven ability to take initiative and able to work efficiently under pressure;
  • Ability to work creatively within a team to analyse and solve problems;
  • Fluency in English; experience in legal translation is an advantage; and
  • Excellent working knowledge of MS Word, Power Point, the internet, and e-mail.
